Information We Collect

2.1 Information You Provide

• User Content: Photos, images, and text you upload for AI processing

  • Only media or prompts you actively select are uploaded and used strictly to generate the AI effect you request.

  • We do not build, collect, or store biometric facial templates, raw facial feature vectors, or persistent facial identifiers.

  • Uploaded media is not used for advertising, user profiling, or AI model pre-training without your explicit consent.

  • Original images and videos are automatically and permanently deleted from our servers after the generation result is returned.

  • AI capabilities run on our proprietary models and private infrastructure; content is not forwarded to third-party AI APIs or external cloud models.

• Communications: Messages you send to our support team

2.2 Usage & Device Information

• Device Information: Device model, operating system version, unique device identifiers

• Usage Data: Features used, templates selected, generation history

• Log Data: IP address, access times, app crash reports

• Credits & Orders : Subscription status, credits balance, task history, and Apple transaction identifiers needed to verify purchases.

How We Use Your Information

We use your information to:

• Provide, maintain, and improve the App

• Process your photos and text inputs through AI models to generate content

• Manage credits

• Provide customer support

• Analyze usage patterns to improve features

• Display relevant advertisements (for non-subscribers)

Device Permissions

FoxArt may request iOS permissions only when they are needed for specific features. You can manage permissions in device settings.

• Photos - Select, import, edit, save, or share media.

• Camera - Capture photos or videos for AI processing.

• Tracking (IDFA) - Support attribution and personalized experiences only after explicit consent where required.

• Notifications - Notify you when an AI generation task is complete or when important account events occur.

AI Processing of Your Content

5.1 How Your Content Is Processed

• Photos and text you submit are sent to our servers for processing.

• Processing is performed solely to generate the content you requested.

• We do not use your personal photos to train AI models without your explicit consent.

5.2 Content Retention

• Uploaded photos are temporarily stored during processing and automatically deleted immediately after generation is complete.

• Generated content is stored in your account history until you delete it or your account is terminated.

• You may delete your generation history at any time from within the App.

Data Sharing and Transfer

We do not sell your personal information. We may share information with:

• Service Providers - We may use trusted infrastructure, analytics, crash reporting, advertising, and payment verification providers under confidentiality and security obligations.

• No Marketing Sale - We do not share submitted media with third parties for their independent marketing or advertising purposes.

• Legal Requests - We may disclose information if required by applicable law, court order, or valid government request.

• International Transfers - Data may be processed outside your region, with safeguards designed to protect confidentiality and security.

Data Security

We implement industry-standard security measures including:

• Encryption in transit (TLS/SSL) and at rest

• retention minimization

However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security.

Acceptance of Terms

By downloading, installing, or using FoxArt (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

FoxArt provides AI-powered photo and video generation tools, including but not limited to:

• Photo style transformation via templates

• Video generation from photos

• Text-to-image generation

• Text-to-video generation

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or legal guardian consent. By using the App, you represent that you meet these requirements.

Credits and Payment

5.1 Free Credits

• New users receive a one-time credit bonus upon registration.

• Free credits are non-transferable and non-refundable.

5.2 Subscription

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

• Payment is charged to your Apple ID account at confirmation of purchase.

• You may manage or cancel your subscription through your device’s account settings.

5.3 Credit Purchases

• Credits may be purchased separately at any time.

• Purchased credits do not expire.

5.4 Refund Policy

• Refund requests must be submitted to Apple

• FoxArt cannot directly process App Store refunds.

User Content

6.1 Your Content

• You retain ownership of the photos, text, and other materials you upload (“User Content”).

• By uploading User Content, you grant FoxArt a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the Service.

• We do not claim ownership of your User Content.

6.2 Generated Content

• Content generated by AI using your inputs (“Generated Content”) is yours to use.

• Subscribers may use Generated Content for commercial purposes.

• Non-subscribers may use Generated Content for personal, non-commercial purposes only.

• We do not guarantee that Generated Content is unique or free from similarities to other works.

6.3 Prohibited Content

You agree not to upload or generate content that:

• Is illegal, harmful, threatening, abusive, or harassing

• Contains child sexual abuse material (CSAM) or exploits minors

• Infringes intellectual property rights of others

• Contains malware or harmful code

• Impersonates another person without consent

• Promotes violence, discrimination, or hate speech

• Is pornographic or sexually explicit

• Violates any applicable law or regulation

Privacy & Data Security

Our processing of information is governed by the Privacy Policy. Where cloud processing is needed, content is encrypted in transit and original media is deleted after task completion as described in that policy.

Intellectual Property

• The App, including its design, code, AI models, templates, and branding, is owned by FoxArt and protected by intellectual property laws.

• You may not copy, modify, distribute, reverse-engineer, or create derivative works of the App.

• Templates and AI models are licensed, not sold, to you.

Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose

• Attempt to reverse-engineer, decompile, or extract AI models

• Use automated scripts or bots to access the App

• Resell, sublicense, or redistribute the App or its features

• Circumvent any technical limitations or security measures

• Generate content that violates the rights of any third party

• Use the App to create deepfakes intended to deceive, defraud, or harm others

Termination

• We may suspend or terminate your account at any time if you violate these Terms.

• Upon termination, your right to use the App ceases immediately.

• Unused credits are forfeited upon termination for cause.

Disclaimers

• The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

• We do not guarantee uninterrupted, error-free, or secure operation.

• AI-generated results may vary and we make no guarantee regarding quality, accuracy, or suitability.

• We are not responsible for how you use Generated Content or any consequences arising from such use.

Changes to Terms

• We may update these Terms at any time by posting the revised version in the App.

• Continued use of the App after changes constitutes acceptance of the new Terms.

• Material changes will be notified via in-app notice or email.

Governing Law

These Terms are governed by and construed in accordance with the laws of Hong Kong SAR, without regard to conflict of law principles.

Subscription Terms

Subscription Terms for FoxArt

By purchasing a subscription to FoxArt, you agree to the following terms:

Billing and Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase.

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

• Your account will be charged for renewal within 24 hours prior to the end of the current billing period.

• The renewal charge will be at the price of the selected subscription plan unless otherwise disclosed.

Managing or Cancelling Your Subscription

• You can manage or cancel your subscription at any time in your Apple ID account settings after purchase.

  1. Open iPhone or iPad Settings.

  2. Tap your Apple ID name.

  3. Tap Subscriptions.

  4. Find FoxArt:AI Photo & Video Maker in the active list.

  5. Tap Cancel Subscription and confirm.

  If no cancel button appears, the subscription may already be canceled and will not renew.

• Deleting the app does not cancel your subscription.

• If you cancel, your subscription will remain active until the end of the current billing period.

Bonus Credits

• Subscribers receive bonus credits as a one-time benefit upon subscribing, not as a recurring monthly credit grant unless explicitly stated in the subscription offer.

• Additional credits may be purchased separately through in-app purchases.

• Purchased credits are non-refundable except where required by applicable law.

Refunds

• FoxArt cannot directly process App Store refunds. To request a refund, visit reportaproblem.apple.com and follow Apple's instructions.

Free Trial and Promotional Offers

• If a free trial or promotional offer is provided, it will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial or promotional period ends.

• Any unused portion of a free trial will be forfeited when you purchase a subscription, where applicable.

Subscription Benefits

A subscription provides subscription benefits of the app, including:

• Latest templates, always fresh

• A one-time bonus credit grant upon subscribing

• Watermark-free exports

• Commercial use rights for generated content

• An ad-free experience

Commercial Use and Watermark-Free Exports

• Active subscribers may use generated content without watermarks and for commercial purposes, subject to applicable laws and third-party rights.

• You are responsible for ensuring that your use of generated content does not infringe the rights of others.

Changes to Subscription Terms

• We may update these subscription terms from time to time.

• Continued use of the subscription after such updates constitutes acceptance of the revised terms.
